1. Introduction

Welcome to 1776 Tax, LLC (“we,” “us,” or “the Company”). These Terms and Conditions govern your use of our tax preparation, business consulting, and audit support services. By accessing or using our services, you agree to comply with these Terms and Conditions. If you do not agree, please refrain from using our services. These Terms and Conditions are legally binding and serve to outline the expectations, responsibilities, and limitations of both 1776 Tax, LLC and you, the client.

2. Scope of Services

1776 Tax, LLC offers a broad range of financial and tax-related services, including but not limited to:

  • Individual and Business Tax Preparation

  • Proactive Tax Planning

  • IRS Tax Compliance and Resolution Assistance

  • Business Consulting and Strategic Financial Guidance

  • Small Business and Non-Profit Tax Strategy Development

  • Audit Support (Non-CPA Representation)

  • Document Review and Organization for Tax Audits

  • Compliance and Risk Assessment for Tax Filing

  • Bookkeeping and Financial Documentation Assistance

  • Advisory Services on Tax Code Interpretation

2.1 Limitations on Services

  • No Legal Representation: 1776 Tax, LLC does not provide legal services or representation before the IRS or state tax authorities unless separately engaged for additional services. If formal legal representation is required, we will refer clients to an appropriate licensed professional (CPA, Enrolled Agent, or attorney).

  • No Guarantees on Tax Refunds or Outcomes: We do not guarantee the acceptance of any tax return by federal or state authorities, nor do we guarantee tax refunds, credits, deductions, or reductions of tax liability.

  • Third-Party Software Use: We may use Drake Software, Stripe, JotForm, and other third-party platformsto process transactions, schedule appointments, and collect sensitive data. We are not liable for any technical failures, service interruptions, or data breaches on third-party platforms.

3. Client Responsibilities

By utilizing our services, you acknowledge and agree to the following responsibilities:

  • You must provide complete, accurate, and truthful information regarding your financial and tax-related matters. Any inaccuracies, omissions, or falsifications may lead to penalties, audit issues, or legal consequences for which 1776 Tax, LLC is not liable.

  • You are responsible for submitting all necessary documentation and financial records on or before the agreed deadlines. Delays in document submission may result in service delays or additional fees.

  • It is your responsibility to review any prepared tax returns for accuracy before submission to the IRS or state tax agencies. Once a return is filed, any amendments or corrections may require additional fees.

  • Clients must comply with all federal, state, and local tax laws and regulations.

  • You acknowledge that tax laws change frequently, and while 1776 Tax, LLC endeavors to provide the most up-to-date advice, you are ultimately responsible for staying informed about how changing tax laws may impact your filings.

4. Tax Filing and Compliance

  • 1776 Tax, LLC operates in full compliance with IRS Circular 230, IRS Publication 4557 (Safeguarding Taxpayer Data), IRS Publication 5293 (Data Security Guide for Tax Professionals), and applicable federal and state regulations.

  • 1776 Tax, LLC will prepare your tax return based on the information provided by you. We are not responsible for errors resulting from misinformation, misrepresentation, or omissions on your part.

  • Clients are responsible for ensuring all tax filing deadlines are met. If a client fails to provide necessary information on time, 1776 Tax, LLC is not liable for late filing penalties or interest imposed by tax agencies.

5. Payment Terms and Fees

  • Fees for services are listed on our website and are subject to change without notice.

  • Payment is required before the submission of tax returns or completion of consulting services. Services will not commence without confirmed payment.

  • Clients using "Pay-by-Refund" authorize fees to be deducted from their tax refund as permitted by IRS regulations. Additional administrative fees may apply.

  • No refunds will be issued once a return has been filed. If a client chooses to discontinue services after work has commenced, no partial refunds will be provided.

6. Confidentiality and Data Protection

  • We do not share, sell, or distribute client information to third parties, except as required by law or with the explicit consent of the client.

  • We implement industry-standard encryption for client data, enforce two-factor authentication, and use a private VPN to protect sensitive information.

  • Clients are responsible for safeguarding their own tax records, login credentials, and sensitive financial documents.

7. Limitation of Liability

  • 1776 Tax, LLC shall not be held responsible for IRS penalties, interest charges, or audits resulting from client errors, misinformation, or failure to comply with tax laws.

  • We provide advisory services but do not guarantee specific tax refund amounts, approval of tax credits, or favorable audit outcomes.

  • Liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service rendered.

8. Force Majeure

  • 1776 Tax, LLC shall not be liable for any failure or delay in services due to events beyond our control, including but not limited to: acts of God, government shutdowns, cyberattacks, power failures, or natural disasters.

9. Cancellation and Rescheduling Policy

  • Clients must cancel or reschedule appointments at least 24 hours in advance.

  • No refunds will be issued for missed appointments without prior notice.

10. Dispute Resolution and Arbitration

  • Any disputes arising from our services shall be resolved through arbitration in the state of Colorado.

  • Clients waive their right to class-action lawsuits against 1776 Tax, LLC.

  • If a dispute arises regarding tax services, the client must first attempt to resolve the issue through internal review before pursuing legal action.

11. Amendments and Governing Law

  • These Terms and Conditions may be updated at any time. Continued use of our services implies acceptance of any changes.

  • This agreement is governed by the laws of the United States and the State of Colorado.
